2. Purpose of this manual
This manual tells you which records Bam Cloud AI (Pty) Ltd holds, which of them are available without a formal request, how to ask for the others, what it costs, and how we process personal information.

4. The Regulator's guide to PAIA
Section 10 of PAIA requires the Regulator to publish a guide explaining how to use PAIA and POPIA. The guide is available in every official language, and in braille, from the Information Regulator:

5. Records available without a request
These are freely available on bamcloudai.com, with no request or fee: service descriptions, published prices, Terms & Conditions, Refund Policy, Privacy Policy, FAQ and this manual.
6. Records kept under other legislation
Where the law requires them, we keep records under:

7. Subjects and categories of records held

A record falling in one of these categories is not automatically available. PAIA sets out grounds on which access must or may be refused, for example to protect another person's privacy, commercial information or confidential information (PAIA Chapter 4 of Part 3).
8. How to request a record
- Complete Form 2 (Request for Access to Record), prescribed by the Regulations Relating to the Promotion of Access to Information, 2021. It is available on the Regulator's website.
- Email it to the Information Officer at gustav@bamcloudai.com.
- Identify the record, the form of access you want, and the right you are exercising or protecting and why you need the record for it (PAIA s53).
- If you are asking on someone else's behalf, include proof of your authority.
We will decide on your request within 30 days of receiving it. We may extend this once, by up to 30 days, in the circumstances PAIA allows, and we will tell you if we do. If you are refused, you may complain to the Regulator or apply to court.
9. Fees
Fees are those prescribed in Annexure B to the 2021 PAIA Regulations: a request fee, plus an access fee for reproduction and for any search and preparation time beyond the free allowance. A requester asking for their own personal information does not pay the request fee. We will tell you the fee payable, and any deposit, before we do the work.
10. Processing of personal information (POPIA s51(1)(c))
10.1 Purpose. We process personal information to respond to enquiries, deliver and invoice training and consulting services, meet legal and tax obligations, record training deliveries as the Microsoft Certified Trainer programme requires, and, where the law allows, keep clients informed about our services.
10.2 Categories of data subjects and information

10.3 Recipients. Service providers that process information on our behalf (customer relationship management, email and file storage, website hosting, payment processing, exam-voucher issuing and course evaluation), our accountant, SARS, and anyone a law or court order requires. Our Privacy Policy names each provider.
10.4 Planned cross-border transfers. Contact and enquiry information is stored with providers whose infrastructure is in the European Union, the United States and elsewhere. We rely on section 72 of POPIA and on each provider's data-processing terms.
10.5 Security measures. Encryption in transit, access limited to the director, providers with recognised security certifications, and payment details handled entirely by the payment providers.
11. Availability of this manual
This manual is published at bamcloudai.com/paia-manual.html. A copy is available on request from the Information Officer at no charge, or for inspection at our physical address. Anyone who wants a paper copy may be charged the prescribed reproduction fee.
12. Updates
The head of the private body reviews this manual at least once a year, and whenever our records or processing change.
