1. Who We Are
Bam Cloud AI (Pty) Ltd (registration number 2026/578688/07) is a private company incorporated in South Africa under the Companies Act 71 of 2008, with Gustav Bam as its sole director, based in Durbanville, Cape Town. It trades as “Bam Cloud AI” under the domains bamcloudai.com and bamcloudai.co.za, from 2 Eike Street, Wellway Park, Durbanville, 7550 (telephone 081 025 3722). These Terms & Conditions ("Terms") govern any training, coaching, workshop, or consulting service booked directly with Bam Cloud AI. For queries, contact gustav@bamcloudai.com.
2. Services Covered
These Terms apply to services booked and paid for directly through Bam Cloud AI, including:
- 1-on-1 Microsoft Azure certification coaching (AZ-900, AZ-104, AZ-305)
- Azure training sessions and workshops (half-day, full-day, corporate group sessions)
- Azure architecture and cloud consulting (hourly advisory, project-based engagements, retainers)
3. Bookings & Scheduling
Sessions are booked via the booking links published on bamcloudai.com or by direct arrangement over email. A booking is confirmed once payment (or, for invoiced clients, a signed order/SOW) has been received. Rescheduling requests should be sent to gustav@bamcloudai.com as early as possible — see our Refund Policy for notice periods.
4. Fees & Payment
Current rates are published on the Pricing page and are quoted in ZAR (local training/consulting) or USD (international coaching). Bam Cloud AI (Pty) Ltd is not a registered VAT vendor, so no VAT is charged and no VAT is added to any price — the amount shown is the amount payable. Accepted payment methods are listed on the Payment page: card/Instant EFT via PayFast (South African clients), Payoneer (international clients), or direct EFT/invoice (South African clients). Payment is due prior to the session or per the terms stated on the invoice/SOW for project-based work.
5. Cancellations, Rescheduling & Refunds
Full details, including notice periods and how much (if anything) is refundable, are set out in our Refund Policy, which forms part of these Terms.
6. Client Responsibilities
For consulting engagements, the client is responsible for providing timely access to relevant systems, environments, and personnel needed to deliver the engagement, and for the accuracy of information provided. For training sessions, participants are responsible for having a stable internet connection and any prerequisite software (e.g. an Azure free-tier or sandbox subscription) unless otherwise agreed in advance.
7. Intellectual Property
Training materials, slide decks, lab guides, and other course content remain the intellectual property of Bam Cloud AI. Clients and participants receive a personal, non-transferable licence to use materials for their own learning. Materials may not be resold, redistributed, or used to deliver training to third parties without prior written consent.
8. Confidentiality
Any client information, business data, or technical environment details shared during a consulting engagement are treated as confidential and used solely for the purpose of delivering that engagement. A separate mutual NDA is available on request for engagements involving sensitive data.
9. Limitation of Liability
Bam Cloud AI provides training and consulting services with reasonable skill and care, consistent with 30+ years of enterprise IT experience and current Microsoft certification standards. To the extent permitted by South African law, Bam Cloud AI's liability for any claim arising from services provided is limited to the fees paid for the specific service giving rise to the claim. Bam Cloud AI is not liable for indirect or consequential loss, including loss of business, profit, or data, except where such exclusion is not permitted by law.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or the services provided will first be addressed through good-faith direct negotiation between the parties, and then as set out in section 11.8.
11. Supplier Information and Your Rights as a Consumer
This section sets out the information that section 43 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA) requires us to make available. It applies to every service bought through this website.
11.1 Supplier details

11.2 Code of conduct
Bam Cloud AI does not subscribe to an industry code of conduct as contemplated in ECTA section 43(1)(e). Gustav Bam delivers Microsoft training as a Microsoft Certified Trainer (MCT) and is bound by the MCT Program Agreement.
11.3 When services are delivered
- Every booking: we confirm the date or dates in writing within two business days of receiving payment, and the service is delivered on the dates agreed.
- Open online certification cohorts: a cohort runs once four delegates are booked. If that minimum is not reached by the advertised start date, you choose between a later date and a full refund.
- Exam vouchers: the exam voucher included with a certification course is issued by the last day of the course. If we cannot issue it, we refund the cost of the voucher.
- Achievement codes: each delegate on a certification course receives a Microsoft Learn achievement code by the last day of the course, which records the completed course on their Microsoft Learn profile. An achievement code records attendance; it is not a certification, which is earned only by passing the exam.
- Consulting projects and retainers: delivered to the timeline in the signed Statement of Work (SOW). No service is sold as an automatically renewing subscription; a retainer runs only for the term stated in its SOW.
11.4 Reviewing your order before you pay
Nothing is charged through a website form. You receive a written quote or invoice, and a booking exists only once you pay it. Until then you can review the details, ask us to correct any mistake, or simply not proceed.
11.5 Records of your transaction
For every purchase you receive, by email, a booking confirmation, our invoice and the payment provider's receipt. We keep transaction records for seven years and will email you a copy at any time, free of charge.
11.6 Payment security and privacy
Card and bank payments are made on PayFast's or Payoneer's own secure pages. We never see or store your card details. How we handle personal information is set out in our Privacy Policy.
11.7 Cooling-off
Consumers have a seven-day right to cancel under ECTA section 44. How it works, and when it ends early, is set out in section 2 of our Refund Policy.
11.8 Complaints and disputes
Bam Cloud AI does not subscribe to an alternative dispute resolution (ADR) code. Disputes are handled as follows:
- Email gustav@bamcloudai.com, or call 081 025 3722. We reply within five business days.
- If the matter is not resolved within 20 business days, either party may refer it to mediation before a mediator both parties agree on. Mediation costs are shared equally.
- As a consumer, you may at any time complain to the National Consumer Commission or the Consumer Goods and Services Ombud (0860 000 272), and, about personal information, to the Information Regulator. Nothing in these Terms limits your right to approach a court.
12. Changes to These Terms
These Terms may be updated from time to time to reflect changes in services, pricing, or applicable law. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of Bam Cloud AI's services after an update constitutes acceptance of the revised Terms.
